These Terms of Service ("Terms") govern your access to and use of Write85 (the "Service"), a product of SBR Worldwide, LLC ("Write85", "we", "us"). By purchasing a subscription or using the Service, you agree to these Terms on behalf of yourself and, if you purchase a team plan, on behalf of your organization and its users.
Write85 is an AI-assisted writing platform. Each customer account is trained on writing samples, guidance, and knowledge that the customer provides, and produces written and visual content based on that training and on user requests. Output is generated by artificial intelligence and should be reviewed by you before use. You are responsible for the accuracy, legality, and appropriateness of any content you publish or send.
An account is created when your purchase is completed. Your username is the email address used at checkout, and you will receive an email to set your password. You are responsible for keeping login credentials confidential and for all activity under your account. Team plan administrators are responsible for the users they add and may set per-user permissions. Each seat is for one named individual; credentials may not be shared.
Each plan includes a monthly word allowance that renews at the start of every billing cycle (for example, the Individual Starter plan includes 3,000,000 words every month). The allowance covers the words processed to produce your content, including chat and image creation. Unused allowance does not roll over between cycles. Optional word packs may be purchased inside the app; word packs apply to the current billing cycle only and expire when the cycle renews.
If your account reaches its allowance for a cycle, content creation pauses until you add words or your allowance renews. We may apply reasonable technical safeguards against abuse or automated misuse of the Service.
All purchases are processed by FastSpring, our merchant of record. FastSpring handles secure payment processing, applicable global sales tax and VAT, and card storage, and their name may appear on your card or bank statement. Your payment details are provided to FastSpring, not to us. Subscriptions renew automatically each month or year, depending on the plan you selected, until canceled. Plan changes and cancellation are self-service through the FastSpring account portal linked inside the app.
You may cancel your subscription at any time. When you cancel, your subscription remains active through the end of the period you have already paid for, and it will not renew after that. Purchases are non-refundable, including partially used subscription periods and word packs. If you believe you were billed in error, contact us at sam@samrichter.com and we will review it.
You retain ownership of everything you provide to the Service (your training materials, uploads, and requests) and everything the Service produces for you, to the maximum extent permitted by law. Your training materials and content are stored in your account's own isolated space and are not shared with other customers. We do not use your content to train AI models. You grant us the limited rights needed to operate the Service, such as storing your materials and transmitting them to the AI providers that process your requests.
You are responsible for having the necessary rights to the materials you upload, and you agree not to upload content that infringes the rights of others.
We may suspend or terminate accounts that violate these Terms.
The Service relies on third-party providers, including AI model providers that process your requests, FastSpring for payments, and Postmark for transactional email such as account and password messages. Their processing of data is described in our Privacy Policy.
We work to keep the Service available and improving, but it is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We may add, change, or remove features. If we make material changes to these Terms, we will update this page and the date above; continued use after changes means you accept the updated Terms.
To the maximum extent permitted by law, SBR Worldwide, LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from or related to the Service. Our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the twelve months before the event giving rise to the claim.
You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or non-payment. Upon account termination, your stored materials may be deleted after a reasonable period; contact us before termination if you need your materials.
These Terms are governed by the laws of the State of Minnesota, USA, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in Minnesota.
